Commissioners postpone decision on proposed CRI Tree Service rezoning near Hickory Flat Highway

Cherokee County commissioners voted Feb. 4 to postpone for two weeks consideration of a rezoning request from Jacob Miller for CRI Tree Service that would change 4.5 acres from R‑40 to General Commercial (GC) for a tree service operation.
Zoning staff told the board the Planning Commission had recommended denial at its earlier hearing. The rezoning request included a concurrent variance to eliminate the required 35‑foot zoning buffer between GC and R‑40, which the Planning Commission did not recommend. Staff noted the application leaves an existing residence on a separately owned R‑40 parcel out of the rezoning.
County staff described the proposed site as south of the Mountain Road, Ernie Road and Hickory Flat Highway intersection, across from an existing shopping center. At the public hearing the applicant indicated material storage would be limited primarily to equipment and work trucks and that portions of the site would be fenced.
The applicant initially sought to withdraw the application but then asked the board to postpone to consider options, including submitting a revised application or adding conditions. Commissioner Weather (recorded as Commissioner Weatherby in other parts of the meeting) moved to postpone the decision for two weeks; Commissioner Carter seconded. The motion carried unanimously.
Planning staff advised that because the Planning Commission recommended denial, the board’s options include sustaining the denial, scheduling a public hearing before the board for formal consideration, postponement, or allowing the applicant to withdraw. The applicant chose postponement to pursue possible modifications.
