The Cherokee County Board of Commissioners voted unanimously Feb. 4 to rezone about half an acre at 3293 Arbor Hill Road from agricultural (AG) to R‑40, a change the owner said will allow the parcel to be split and given to her children.
The rezoning clears a nonconforming condition on a parcel that currently contains two homes. Zoning staff told the board the split would leave each home on its own lot and bring the site into conformance with the county map. Planning staff presented aerials and a survey indicating the proposed new property line; the applicant has agreed to remove a shed that currently encroaches on a neighbor’s lot or otherwise adjust the surveyed line when the final plat is submitted.
Zoning Administrator Trey summarized the request and said the Planning Commission recommended approval at its January meeting. Commissioner West, whose district includes the property, moved to approve the rezoning and Commissioner Wetherbee seconded the motion. The board called the question and voted unanimously to approve the change to R‑40.
During the discussion, staff noted a legacy‑lot solution would not work because a portion of the parcel is zoned AG and therefore would require a minimum two‑acre area for that portion; the applicant’s acreage does not meet that threshold. Staff also flagged the shed encroachment as an item the applicant must address administratively with the surveyor before final plat recording.
The approval was presented as a straight rezoning; no variances or special conditions were imposed at the meeting. The board’s action resolves the split‑zoned, nonconforming status identified by county planning staff and authorizes the applicant to proceed with the lot split process under county subdivision requirements.
The rezoning motion was recorded as passed; no dissenting votes were recorded.
