Depew board finds Phase 9 sewer work a SEQRA Type II action; no further environmental review required

The Village of Depew Board of Trustees voted Jan. 27 to classify Phase 9 of the village's sanitary sewer repair program as a Type II action under the State Environmental Quality Review Act (SEQR), finding the work categorically will not have significant adverse environmental impacts and therefore requires no further SEQR review.
Village staff and the village attorney explained the work: the project covers sanitary sewer rehabilitation in Sewer Shed No. 6, following a Phase 9 Sanitary Sewer Evaluation Survey (SSES) intended to identify corrective actions to reduce sanitary sewer overflows. The work includes pulling pavement and excavating to repair or replace sewer infrastructure in kind.
During the meeting the village attorney (Sam) described the SEQR obligation tied to prospective funding through the New York State Clean Water State Revolving Fund. Citing 6 NYCRR 617.5 (SEQR), staff recommended a Type II determination because the proposed work involves maintenance, repair and in-kind replacement of existing sewer infrastructure without a substantial change to the system.
The board approved the Type II finding on roll call; trustees said the determination will allow the village to move forward with funding applications to the Clean Water State Revolving Fund and with the project design and bidding process.
