Aurora council approves boundary changes for Painted Prairie and Windler business improvement districts

The Aurora City Council on Feb. 24 adopted four ordinances that revise boundaries for Painted Prairie Business Improvement Districts Nos. 1 and 2 and Windler Business Improvement Districts Nos. 1 and 2 after the developer modified the projects’ plans, city staff said.
Michael Kerrigan, special districts administrator with the Development Services Department, told the council the developer provided the statutorily required petitions and maps showing the updated boundaries and that the changes were needed because certain tracts originally intended as commercial are now planned for residential use. State statute does not allow residentially assessed property to be included in a BID, so the districts must be adjusted, Kerrigan said.
The council opened and closed public hearings on each ordinance with no members of the public speaking. Counsel for the BIDs explained that multiple BIDs were formed to provide financing flexibility early in development planning and that boundaries are being adjusted now as the developer’s platting has evolved.

Why it matters: Business improvement districts levy assessments or provide financing tools for maintenance and improvements on property inside their boundaries; changing boundaries to remove parcels that will be assessed as residential alters which parcels can be assessed and which financing tools are available to the commercial areas. The council packet included statutory petitions and comparison maps for each district.
