Dec. 4 — The Ada County Board of Commissioners approved a property boundary adjustment and accompanying variance (project 202402340 PBA V) presented by Sawtooth Land Surveying to correct illegally created parcels in Colter View Estates and bring the properties closer to compliance with Rural Urban Transition district standards.
County staff described the history of the subdivision, platted in 1994, and explained that portions of lot 1 had been sold and altered without approved plat amendments, creating illegal parcels. The current proposal covers three properties totaling about 13.43 acres in the rural urban transition district; staff said the adjustment will create two legally conforming properties and make a third closer to conformance with the five-acre minimum in that district. Staff recommended approval. "Staff finds this proposal complies with Ada County code and recommends approval to the board," a planning staff member said during the presentation.
The staff report noted that agencies with concerns for public health, safety and welfare raised no objections to the proposal. The Boise Project Board of Control asked the applicants to remain mindful of Rosson Canal easements and to keep those easement areas flat and drivable. The adjustment follows a 2022 precedent in which the board approved a similar variance and adjustment for another lot in the subdivision.
A commissioner moved to approve the application "based on the findings of fact and conclusions of law in the staff report," the motion was seconded, and the board voted in favor. All commissioners present said "aye." The public hearing was closed and the approval was recorded in the meeting minutes.
The approval resolves outstanding legal nonconformities created by past unapproved parcel alterations and preserves the existing number of buildable parcels while bringing the properties closer to the county's dimensional standards for the RUT district.
