Boca Raton planning board approves TBT Athletics site changes, conditional use for training facility

The City of Boca Raton Planning and Zoning Board voted 6-0 Feb. 20 to approve a site-plan amendment and a conditional-use permit allowing an 11,980-square-foot athletic training facility at 5801 Congress Avenue.
The approvals resolved an existing code-enforcement case by bringing the operation into compliance, authorized minor exterior changes including restriping portions of the surface parking area, widening sidewalks from 5 to 6 feet in sections, adding a new 6-foot sidewalk and interior crosswalks, and reduced the number of off-street parking spaces required under the code from 139 to 127 through a technical deviation.
The TBT Athletics facility is sited on an approximately 5.98-acre property at the northwest corner of Congress Avenue and Northwest Broken Sound Parkway in the Light Industrial and Research Park (LIRP) zoning district. Owen Devlin, senior planner with Development Services, told the board the proposal does not change the building’s height, square footage or floor area. He said staff determined adequate parking is available for the use and that the city had not received parking complaints at the site. Devlin also said the property currently contains 121 parking spaces.
Devlin said the applicant had provided corrected survey information regarding the northern setback: "it was determined that the measurement was within the acceptable margin of error resulting in an adjustment of the setback to 35 feet on the revised site plan." The revised setback and other corrected plan materials were provided to board members in advance of the hearing.
Devlin noted that on Sept. 12, 2023, the City Council adopted Ordinance No. 56-58 adding athletic training facilities as a conditional use in the LIRP zoning district. He said the applicant was operating the training facility before obtaining conditional-use approval and that the city had issued a code-enforcement notice asking the applicant to obtain formal approval.
David Millage, representing the applicant, told the board he had no additional material to add to staff's presentation and was available to answer questions. When a board member asked whether there is an occupancy limit tied to zoning, Devlin replied, "No. We do not have a condition to stop the number of members or guests at the facility." He clarified that building- and fire-code occupancy limits still apply and are established through permitting for interior renovations.
Following public hearing procedures and no public speakers, the board voted to approve the site-plan amendment (agenda item 5.a.1) and the conditional-use application (agenda item 5.a.2) by roll call, each by a 6-0 vote. Staff had recommended approval to City Council.
The approvals amend a previously approved site plan and include a technical deviation from section 28-16-55 of the City Code of Ordinances to reduce required parking. The action also specifically repeals an earlier Planning and Zoning Board resolution listed in the application materials.
