The Kane County Planning and Zoning Commission on Feb. 12, 2025 recommended approval of Ordinance O‑2025‑03, which revises Chapter 21 (subdivisions) of the Kane County Land Use Ordinance to reflect recent statutory changes and to designate the administrative land‑use authority (the land‑use administrator) as the body responsible for subdivision review.
Shannon, county land‑use staff, told the commission the Legislature required changes to subdivision procedures last year and that the county moved to make the land‑use administrator responsible for administrative subdivision approvals. She said the current ordinance codification missed a number of administrative edits during earlier revisions; the proposed ordinance corrects those omissions and standardizes references to the "Kane County Construction Design Standards." Among the changes are removing references to the planning commission as a recommending body for subdivisions and updating the process flow to a county administrative review.
Shannon described several operational items to be added or clarified, including a required pre‑construction conference with developer, engineer, utility providers and county staff; electronic plat submission; clarified rules about lot joiners/simple boundary adjustments and notification radii (revised in the draft from 500 to 300 feet to match common practice and state code). She said most developers appreciate the pre‑construction conference because it reduces later confusion.
After a public hearing with no speakers, a commissioner moved and the commission voted to recommend the ordinance to the county commission. Shannon said the county commission retains final authority on dedication of improvements and county acceptance of subdivision roads, even with the administrative review changes.
