"These buildings are in very good condition and to correct the encroachment would require them being demolished," Smith said. He said the encroachment poses no issues to the city or to franchise utilities and that the agreement had been reviewed and approved by the city attorney.
Councilmember Mister Mayer moved approval and the council adopted the measure by voice vote; the council did not record individual roll-call votes on the record. The motion authorized the city manager to execute the agreement.
The staff report and the city attorney's review were entered into the record by reference during the item. The agreement uses the city's standard encroachment form, according to staff remarks.
The council moved on to the next public hearing after approving the encroachment agreement.
