Eureka city attorney to draft comprehensive code enforcement ordinance; council also discusses spring cleanup and building leases

Eureka's city attorney told the council at a work meeting that he will prepare a draft ordinance to establish a comprehensive code enforcement program, including criminal and civil enforcement pathways, abatement authority and civil citations that escalate for repeat violations.

The attorney said the proposed ordinance would include a criminal component for egregious violations, working with the Juab County Sheriff and Juab County Justice Court where appropriate, and a civil side that would authorize abatement in limited circumstances under state law and allow progressively higher civil citation fines for repeat violations. "I'm prepared to have that ready for you for your review by next council meeting," the attorney told the council.

Council members said the city needs a clear, enforceable process so that citations have "teeth" and noted past discussions stalled for lack of a practical process to prosecute or abate violations. The attorney said the ordinance can be tailored to Eureka's needs and that he will meet with the mayor and staff to finalize a draft.

Other municipal business discussed briefly included updating building leases and planning a larger Eureka spring cleanup. Council members discussed the cost of past cleanup dumpster programs and the need to limit after-hours access and restrict nonresident dumping. One council member suggested scheduling an event day during a usual two-week cleanup window and adding community incentives to encourage participation. Staff was asked to coordinate logistics with the landfill manager in advance.

The work meeting recessed and the council adjourned by motion to open the regular meeting; a motion to adjourn the work meeting received unanimous support.
