The draft West Creek development agreement includes a provision that nonmaterial modifications may be processed administratively through the land-use authority rather than requiring city-council legislative action. At the Dec. 5 meeting council members asked whether such a delegation would bypass the council’s legislative role.
A council member asked whether changes to a contract should be approved by the council rather than the land-use authority. Staff replied that the council may delegate certain responsibilities by ordinance and that nonmaterial changes that are "reasonably consistent with the intent of the agreement" and the applicable zone could be handled administratively. The draft text defines nonmaterial modifications as those "reasonably consistent with the intent of this agreement, the applicable zone, or a routine and uncontested matter."
Councilors requested clearer, objective criteria for what constitutes a material versus nonmaterial modification and asked staff to return clarified definitions so the council can decide whether to retain the administrative delegation or require council approval for a broader set of amendments.
No vote was taken on the delegation question; staff will produce a revised definition of nonmaterial modifications and a proposed approval workflow for council consideration.
