Commission approves petition to vacate portion of Logan Martin Dam Road right-of-way

St. Clair County commissioners on July 8 approved a petition from BJ Oil to vacate an unused portion of county right-of-way along Logan Martin Dam Road following a public hearing and a staff report.

Cal (staff member) told the commission the petition had been advertised “for 4 successive weeks beginning June 12 through July 3,” posted as required, and that staff had discussed the request with Dan and Clay. Cal said the county considered the vacation “proper and appropriate.”

The petition, described at the hearing as a request to vacate an unused strip of right-of-way for use by BJ Oil, drew no public opposition during the hearing. A motion to approve the petition carried on a voice vote with no opposition recorded. Commissioners noted a resolution would be prepared for the chairman’s signature to finalize the action.

County Chair Bacon and Commissioner Stevens were absent from the meeting; staff and other commissioners participated in the hearing. The action vacates county control of the identified unused right-of-way segment and clears the way for the applicant to pursue private use or access changes subject to the signed resolution and any applicable conditions.

The commission recorded the public hearing, the staff recommendation, and the subsequent motion and voice vote approving the vacation. The resolution authorizing the county to execute the necessary documents was described by staff as ready for the chairman’s signature.
