Board of Adjustment Panel B approves, denies and holds variances; fee-waiver request denied

The Dallas Board of Adjustment Panel B heard multiple cases and issued a mix of approvals, denials and a continuance at its April 16 public hearing.

Uncontested approvals: The panel approved two items on the uncontested docket, including variance approvals for 3034 Birmingham Avenue (application VDA245‑043 — applicant Rick Smith) and a special‑exception to landscape regulations for an application by Jonathan Vincent (BDA245‑045). The board stated compliance with the most recent version of submitted plans as the required condition for each approval.

Fee reimbursement denied: The board denied a fee‑reimbursement request from Rick Smith (case BDA245‑043‑FR1), who had asked that certain filing fees associated with his previously approved variances be refunded. Smith told the board he had spent “thousands of dollars” over 18–24 months on permits, engineers and zoning fees and said he could provide CPA documentation if required. Staff and board members said the city’s standard for fee waivers centers on “substantial financial hardship,” and the panel found insufficient evidence of that hardship.
