The Dickinson County Planning Commission voted to approve a conditional‑use permit (CUP 24‑07) for a self‑serve fueling station on a parcel at the northwest corner of Highway 4 and Highway 15, at the request of applicant Jason Hahn.
Planning staff told the commission the site contains a dilapidated residence the applicant intends to remove and that the parcel is too small for residential use with well and septic. Staff said a site plan by the applicant’s surveyor was not complete at the time of the hearing but that the applicant provided a concept illustration and a project scope letter for the commission’s review. Staff recommended approval contingent on documentation of coordination with the Kansas Department of Transportation (KDOT) and the Kansas Department of Health and Environment (KDHE) and on full compliance with state and federal safety and environmental requirements before issuance of any building permits.
The staff report noted the area is predominantly farmland with few nearby residences and found the proposed station consistent with the county’s goals for economic development and managed growth. Staff said the proposed use “does not appear to place an uneven burden on existing infrastructure,” provided the applicant secures the required entrance permits from KDOT and satisfies KDHE environmental rules. The applicant told the commission he intends to install pumps and underground tanks and that he is pursuing the required permits and a survey to establish setbacks for tanks as required by local fire officials.
Commissioners moved and seconded approval under the conditions recommended by staff; the motion passed on a voice/hand vote. The planning staff clarified that a building permit would not be issued until the required state approvals and any other listed conditions are provided.
The commission’s approval will be forwarded to the county commission after the statutory appeal period for final action. The staff packet states there were no public comments on this proposal and that environmental services had no objections.
