The Senate State Agencies & Governmental Affairs Committee passed Senate Bill 165, a narrowly targeted procurement change that allows a respondent to amend its proposal when a required clarification triggers a BAFO (best and final offer) process.
Jessica Patterson, state procurement director, told the committee the bill addresses a narrow circumstance in competitive solicitations: when a clarification to a respondent’s proposal would otherwise be treated as a material change and automatically trigger a BAFO that prevents the respondent from amending its proposal. “This is just a very minor tweak that allows that,” Patterson said.
Committee members asked whether the change would affect competitiveness. Patterson replied the current law already permits any bidder “that is reasonably susceptible of being awarded the contract” to participate after a BAFO is triggered; the bill preserves overall competitiveness while allowing more negotiation flexibility when clarifications are needed.
