Commission reviews conditional-use permit compliance at 769 South Main RV campground; staff to follow up

Willard City planning staff and commissioners on Feb. 20 reviewed ongoing compliance questions tied to a conditional-use permit issued Feb. 7, 2020, for an RV campground at 769 South Main (parcel partial number 020530059) under the permit holder Marvin Neff.

Staff told the commission they had reviewed records the owner provided and that the review indicated some occupants had stayed longer than the 90-day limit cited in the ordinance language. City staff said they planned to contact the owner to seek corrective action and to discuss enforcement and monitoring options, such as more frequent drive-through inspections.

Owner/manager representatives who attended the meeting — including Mark Gaff, who said he was involved in the original approval and subsequent operations — disputed broad claims of noncompliance and said they had made improvements to the site since it had been redeveloped. Gaff and other speakers argued the park has been maintained and improved and asked that any enforcement discussion be handled fairly.

Several commissioners asked for clearer interpretation of the ordinance language. The code language cited in the meeting specifies that "no individual space in a recreational vehicle park shall be used by one individual recreational vehicle for more than 90 days consecutively" and that a space "shall not be rented or leased to any one individual for a period longer than 90 days in one calendar year." Staff and commissioners noted ambiguities about whether the limit applies to a single space or to the park generally and said that clarification may be needed.

The commission did not take enforcement action at the meeting. Staff will contact the property owner to attempt resolution and return the matter to the commission if compliance cannot be achieved or further clarification of the code is required.
