Council considers move toward district elections after certified CVRA notice; legal counsel outlines options

City legal counsel and outside counsel briefed council and trustees about a certified letter the city received in December alleging a violation of the California Voting Rights Act (CVRA) and requesting a switch from at-large elections to district-based elections.
Outside counsel Kimon Manolius reviewed the CVRA process and the options available to the city. He said the California legislature created a safe-harbor process to allow local jurisdictions to adopt district-based elections voluntarily after receiving a demand letter; the letter gives the jurisdiction a 45-day initial response window. Manolius said the city had negotiated an extension of that 45-day deadline and that the usual options are to (1) transition to districts under the safe-harbor steps by adopting a resolution of intent and holding required public hearings, or (2) contest the claim in litigation, which he described as costly and difficult to win given how courts have interpreted racially polarized voting and vote dilution claims.
Manolius said the CVRA analysis typically requires demographic and voting-pattern analysis, consulting demographers to draw maps, and public hearings under the California Elections Code. He also noted other Santa Clara County cities have recently moved to district elections after similar letters.
Council members asked clarifying questions about timing and procedure; legal counsel said staff recommended proceeding through the public-engagement and mapping steps necessary for a compliant transition if the council wished to follow the safe-harbor path.
