Planning commission recommends approval of Jerry Williams preliminary subdivision plat in Dickinson extraterritorial zone

The Dickinson City Planning and Zoning Commission on Feb. 12, 2025 recommended approval of preliminary major plat PLP-001-2025 for the Jerry Williams Subdivision, a roughly 35.66-acre tract in the southeast quarter of Section 22, Township 139 North, Range 96 West in the city of Dickinson's extraterritorial zone.
City planner Natalie Burcheck told commissioners the site is zoned agricultural and that the applicant intends to divide the land "to divide the land into appropriate sized lots for each of the residents that are currently living in this tract." Burcheck said staff recommends approval of the preliminary plat.
The commission opened a public hearing. Resident Rita Tomchuck asked, "What's the purpose of the change, I guess?" Burcheck responded that the primary purpose is residential and that two lots in the southeast corner that contain stables will remain as existing, which is a permitted use in the agricultural zone. According to the applicant, there are no lots intended for sale for future development; the subdivision is being used to formalize current ownership patterns.
Commissioner Johansen moved that the commission recommend approval of PLP-001-2025 "as meeting all the requirements of the Dickinson Municipal Code and also being in the interest of the public health, safety, and welfare." The motion was seconded by Commissioner Decker. The public hearing was closed and the commission approved the recommendation by voice vote.
Staff told the commission the road-maintenance contract required for final plat approval had not yet been submitted and that it must be provided before the final plat is considered. The preliminary plat will return to the commission for final plat review and any required submittals.
Why it matters: approval of the preliminary plat advances the formal subdivision process for existing residences in the extraterritorial area and sets the schedule for required final documentation, including the road-maintenance contract.
