County orders quick cleanup at 8813 Fremar Avenue; five-day compliance window with fines if not met

Bay County Special Magistrate Tiffany Sarto on Thursday accepted code enforcement's recommendation that the property at 8813 Fremar Avenue be brought into compliance within five days after investigators documented appliances, junk and overgrowth visible through a damaged privacy fence.
Investigator Tim Justice testified that inspections beginning in October 2024 showed appliances placed outside, junk behind a privacy fence with a large gaping hole and persistent overgrowth. Notices were mailed and posted; certified mail to the owner was returned unclaimed and the investigator said the owner is currently incarcerated and notices were sent to the Department of Corrections as well.
Code enforcement recommended a five-day compliance period to remove all appliances, cut overgrowth and remove junk; if the property owner fails to comply, an initial fine of $300 and daily fines of $50 after the fifth day would begin for up to 25 days and the county would be authorized to abate and assess abatement costs as a lien.
The magistrate accepted the recommendation, noting earlier voluntary compliance on other properties and that the posting and notice requirements had been met. The magistrate scheduled the compliance hearing for March 20, 2025 at 1 p.m. if the property is not brought into compliance within the ordered timeframe.
