New Indiana merit-board law prompts split: Schererville fire to form board; police opted out

The board’s attorney reported on Jan. 9, 2025, that a recent Indiana law will automatically create merit-board processes for police and fire departments, with local departments allowed to opt out. According to the attorney’s report, departmental votes on Dec. 20 resulted in the Schererville Police Department opting out of the merit-board process and the Schererville Fire Department opting in.
Because the fire department opted in, the attorney said the town must constitute a five-member merit board by March 1, and those board members must develop rules, regulations and procedures for hiring, discipline and related matters. The town attorney said he and outside counsel (named in the meeting as Alfredo Estrada and Austin) will assist with meeting statutory requirements and timelines.
The attorney described the implementation work as substantial and said staff will follow the statute’s timelines to ensure the merit board is in place and functioning.
Why it matters: A merit-board system changes how hiring, discipline and appeals are handled for public-safety employees. Schererville’s police and fire departments took different positions, which will change how each department’s personnel matters are handled going forward.
The report did not include a town council vote at this meeting; it was an informational update on statutory requirements and next steps.
