Seaford board reviews draft service-animal regulations; second reading planned

District staff presented draft regulations accompanying a new service-animal policy and the board discussed scope, handler responsibilities and possible exclusions during the Jan. 21 meeting.

“[T]here is a difference between a servicing at home and the emotional support team,” a staff presenter said during the policy discussion, framing the difference the draft regulations are intended to address. The presenter added that handler responsibilities should be clear. “So if somebody says I need service animal but you're gonna have to be the 1 that takes them outside. It doesn't work that way,” she said, describing the draft’s intent to place responsibility for control and supervision with the handler.

Board members raised questions about whether the draft text limited service animals to dogs; one board member noted that federal guidance and other districts sometimes recognize other animals (the transcript included spoken examples such as “small horses”). The presenter said the district commonly sees dogs, but the regulation language can be adjusted to avoid an unnecessary limitation.

The draft also addresses reasons a service animal might be removed or excluded from school settings and touches on the liability implications the district must consider. The presenter said the policy and regulations are a preliminary draft and would return for formal action as part of a second reading process. No formal vote on the policy occurred at this meeting.

Board members instructed staff to revise the regulation language to clarify animal types, handler responsibilities and removal criteria and to bring updated regulations for the scheduled second reading.
