Authority counsel says defendants have sought removal to federal court in SG Blocks litigation

At the Jan. 7 meeting the authority provided an update on ongoing litigation with SG Blocks and related defendants. Attorney Ken Williams read a statement saying certain defendants have filed pleadings to remove the county-court proceedings to the United States District Court for the Eastern District of Oklahoma.
Williams told trustees the removal filings have occurred and that, once defendants file disclosure statements in federal court, the authority will know whether the removal is successful. He said counsel anticipates the removal will be successful and that defendants are likely to seek dismissal through motions; other defendants will be required to file answers, which counsel will evaluate before advising trustees on defenses and next steps.
Trustees asked whether the authority will need additional counsel for federal proceedings; Williams said current counsel is prepared to handle the federal process.
