Mooresville approves conditional rezoning, annexation for Shadowbrook site with 69-unit limit and sewer extension

The Mooresville Board of Commissioners on Feb. 3 approved a conditional rezoning and voluntary annexation for a roughly 17-acre property at 298 Shadowbrook Lane and 994 Brawley School Road, clearing the way for a 69-unit residential development that includes 68 townhomes and one single-family lot.
The ordinance approved by the board requires the developer to construct and dedicate a segment of gravity sewer that staff said will help remove reliance on the nearby Mayhew Promenade pump station, provide a 30-foot buffer adjacent to the Bircham property, construct and dedicate a greenway connection, and set aside three units as “attainable.” The developer also committed to two right-in/right-out driveways on Brawley School Road and to preserve an existing house and its site as a single-family lot.
The project was described to the commissioners by Erica Martin, director of planning and community development, who said the site is currently in Iredell County and would, if annexed, be placed in Ward 4 and served by Iredell‑Statesville Schools. Martin said the proposal reduced density from a prior plan for 99 townhomes to 69 units and added a second entrance to address earlier concerns about a single access point. She said the developer’s conditions include sidewalks and greenway construction that would not be required under county development.
Utilities director Allison Craft told the board the developer’s sewer extension would advance a capital project to extend gravity sewer from the town’s existing collection system up toward the Mayhew Promenade area, reducing pump‑station maintenance and alleviating potential upstream capacity concerns. Craft said the town and the property owner negotiated an easement that would allow the extension to be constructed now and continued later if adjacent projects develop.
Applicant representative Scotty McAllager of Blue Hill Development said his team reached an easement agreement with adjacent owners and will purchase the needed easement; he also gave a planning-stage estimate for off-site sewer construction. "Our number right now is a little bit more than 200 to construct it," McAllager said, referring to dollars per linear foot and the linear footage required; he said that estimate excludes the easement purchase price.
During public comment, resident Jack Benyon said he attended the neighborhood meeting and pressed for the traffic data and for clarification about school capacity and evacuation planning; staff later confirmed traffic counts from NCDOT and said children from the development would attend Iredell‑Statesville Schools. Commissioner Qualls moved approval with the conditions shown in staff materials; Commissioner DeWeese seconded. The motion carried and the board approved both the conditional rezoning ordinance and the voluntary annexation ordinance.
The rezoning carries binding, site-specific conditions and will be enacted through an ordinance and a property-owner affidavit, as described by staff.
