Daggett County discusses vacating right-of-way, parcel transfer and bond timing for clinic

Daggett County commissioners discussed steps to vacate a right-of-way, create a new parcel and transfer it to the Municipal Building Authority so the county can secure bond financing for a planned clinic.
County staff said drawings for the clinic are expected to be complete by the end of the month and that, depending on the bidding schedule, contract numbers and final costs could be available within roughly four to six weeks after bids are issued. "The drawings, I think, are supposed to be, complete or very, very close by the end of this month, to put out for bid," one commissioner said.
The commission and staff outlined a sequence they said must be completed before the county can finalize bond work with the state infrastructure lender. That sequence, as described at the meeting, is: vacate the right-of-way; create the new parcel; transfer the parcel from the county to the Municipal Building Authority (MBA); and then complete bond paperwork with the Community Impact Board (CIB) or similar lender. "The right of way needs to occur first, then the transfer, then the creation of the new parcel, and then the transfer to the MBA and then the bond associated with CIB," a county official said.
Officials said the county expects CIB to want collateral and that land is the likely form of collateral. Staff recommended transferring the ground the clinic will sit on to the MBA so the parcel would be available as collateral if required. "My expectation would be that we transfer from the county to the MBA the parcel that the clinic will sit on," one commissioner said.
Members also discussed how the parking lot for the clinic would be handled. Staff reported the parking lot was shown on the plans submitted to CIB and that some CIB funding was available for the parking lot. "There is funding from CIB for the parking lot itself as well," a staff member said.
Because bond sizing typically requires specific contract numbers, commissioners noted the bond process could move quickly once bid numbers exist. "We won't have final numbers... until it goes out to bid, which we would need, I would assume, for the bond," a county official said.
County staff identified next administrative steps: complete the right-of-way vacation paperwork, work with surveyors and engineers to create the parcel, coordinate the legal transfer with the county attorney, and follow up with bond counsel to include any required transfer/transferability language.
The discussion closed with staff noting the potential need to expedite those items so contractors can be lined up quickly if the project proceeds on the proposed schedule.
