The Riverton Planning Commission approved a conditional home‑occupation permit on Feb. 13 for D and J Diesel Performance to operate a mostly mobile vehicle‑maintenance service based at a detached garage, while removing permission to perform motor‑vehicle repairs at the residence.
Staff explained the applicant, Dustin and Megan Clark, proposed a mobile service for light‑duty trucks and requested use of a detached garage as a base for storage and occasional part installations. The applicants said most work would be performed at customers’ sites; they expect one full‑time nonresident employee and estimated roughly five deliveries per week. The staff packet noted detached accessory structures may be used up to 50 percent for a permitted home occupation; more intensive use is allowed only on lots of at least one‑half acre.
Several commissioners and members of the public raised concerns about parking, diesel exhaust and noise, storage of fluids, and whether installing new parts at the garage would be classified as motor‑vehicle repair. Neighbors asked how the city would enforce permit conditions if complaints arise.
During deliberations, commissioners focused on the definition of “repair.” Several commissioners said that removing on‑site repair was necessary to adhere to code that generally prohibits motor‑vehicle repair in residential zones. The commission amended the staff recommendation by striking the portion of the condition that would have allowed vehicles to be brought to the home for part installations; language permitting the detached garage to be used for business storage and for the employee to use the driveway as screened behind the gate was retained.
Commissioner Clough moved to approve the application with conditions 1–6 but omitting condition 5 (the provision that would have allowed on‑site repair); Commissioner Kiel seconded. The motion passed unanimously on a voice vote. The approval includes the 50 percent accessory‑structure limit and explicit prohibitions on vehicle storage and on‑site repair. The planning department and code‑enforcement staff will monitor the site and may pursue revocation of the conditional use permit if conditions are violated.
