The Garland Plan Commission on Feb. 10 voted unanimously to forward an amendment to the Garland Development Code that would make plat approvals administrative when plats meet technical requirements, and to clarify related procedures and appeals.
Staff said state law treats plats as ministerial: if a plat meets technical standards, local authorities must approve it. The proposed change would allow the planning director or an authorized designee to approve plats administratively rather than placing routine plats on the Plan Commission consent agenda. Staff said the amendment aims to speed the plat process and reduce routine agenda items while preserving a path for appeal.
Under the proposed procedure, the planning director or an authorized designee would approve plats that meet technical standards; parties disagreeing with a staff determination could appeal to the Plan Commission. Staff also said the city surveyor, building inspection and other technical reviewers would remain involved in the review and that only certain plats would require public notification under existing code provisions.
Commissioners asked for safeguards and clarity about due process. Commissioner Jenkins noted constitutional due-process considerations referenced earlier in the discussion (Article 1, Chapter 17 of the Texas Constitution and the Fifth Amendment were raised as context for appellant protections); staff and the city attorney's advice clarified that the appeal route to Plan Commission would preserve applicant due process and that neighbors traditionally do not receive mailed notice for standard plats. Several commissioners requested that staff circulate a monthly memo listing plats approved administratively so commissioners can track approvals.
Commissioner Dalton moved and Commissioner Paris seconded approval of the amendment with instructions to correct minor numbering/typographical errors; the motion passed unanimously. Staff said they will include the list of administratively approved plats in the commission's regular materials and noted that other ordinance updates will follow to harmonize cross-references in the Code.
