Judge Boyd schedules competency recall for Adeline Steely after hospital letter flagged concerns

Judge Stephanie Boyd scheduled a recall for Nov. 10 to address competency concerns raised in a medical communication regarding Adeline (last name Steely).
Defense counsel noted a letter from a jail doctor (Dr. Brian Scott) stating that the individual “may require a competency evaluation” and that the letter lacked detail. The court and defense discussed whether a formal competency evaluation had been properly requested and whether defense counsel had been consulted; counsel said they had not requested an evaluation but had reviewed the letter and did not believe the defendant would ultimately be found incompetent. The court acknowledged an evaluation had been scheduled (a TAP or competency evaluation) and that the evaluation date—around Nov. 2 or Nov. 3—was not far away.
Because of the outstanding evaluation materials and the need to ensure defense counsel had an opportunity to review the results, Judge Boyd recalled the defendant for Nov. 10. Defense counsel indicated they expected the defendant to be found competent. The court advised that judges should be made aware when non-attorney parties file motions or medical evaluations without conferring with defense counsel.
