The Village of Hortonville board considered a resident’s request that the village reimburse asphalt repair for the driveway apron at 455 East Main Street, which the resident said was damaged during state highway reconstruction work.
Board members and staff reviewed the background provided by the resident’s submission and questioned whether the state Department of Transportation (DOT) or the village bears responsibility. Trustees said the DOT told the resident the project was closed and declined to act. Village officials asked whether the damaged area falls within the village right-of-way or private property and whether photos or before-and-after documentation exist to show the damage was caused by the state’s project.
Village staff said they had not inspected the site in detail and requested quotes and photographic evidence before bringing a formal reimbursement request forward. The village attorney observed that if the state caused the damage, the village would not necessarily be obligated to pay and that claims against outside agencies typically are handled by the responsible party. Trustees discussed past examples (electric utility reconstruction) where the responsible outside party repaired damages rather than the village doing so.
The board did not approve reimbursement at the meeting. Trustees asked staff to request any photos the resident has, obtain contractor quotes and check whether the area will be reconstructed in a near-term project that might cover the work. A motion was made and carried (per the transcript) to incorporate the request and proceed with staff follow-up; details were not specified in the open meeting record.
