The council adopted a resolution on Oct. 21 establishing the town’s real property acquisition and eminent domain policy to comply with Article II, Section 17 of the Arizona Constitution, Title 12, Chapter 8 of the Arizona Revised Statutes and other applicable laws.
Staff presented the policy as an administrative tool to ensure transparent, lawful procedures when right-of-way or other real‑property acquisitions may be needed for public infrastructure. The manager and town attorney said the town will continue to prioritize voluntary negotiations and relocation assistance, but the policy preserves legal tools the town may need to complete public projects.
Councilors had no substantive objections and approved the resolution by voice vote.
