KUNA — The Kuna City Council unanimously approved a combination plat and a modification that dissolves a prior development agreement for the Lamp District, consolidating six lots into a single C-2 commercial parcel at the northeast corner of North Meridian Road and East Deer Flat Road.
The vote, to approve case numbers 2401CPF and the 22-02 development agreement modification, followed staff recommendation that the plat and modification comply with Kuna City Code, the comprehensive plan and Idaho law. Doug Hansen, Kuna planning and zoning director, told the council that staff recommended approval with the conditions listed in the staff report.
The approval removes the existing development agreement and converts the property to a single commercially zoned 34-acre parcel rather than the previously proposed mixed-use “village.” Penelope Constantakis, representing the project team, said the change responds to neighborhood concerns and school-district opposition to the earlier village concept: "We pulled back and started in a different direction; this creates one parcel and simplifies the site so future development can proceed more practically and efficiently," she said.
Why it matters: Councilors and applicants said the consolidation is intended to make the site technically easier to develop, removing numerous internal lot lines and several nonfunctional easements. The applicant said the consolidation should reduce surveying and platting obstacles and make the site more attractive to multiple potential users rather than being constrained by fragmented ownership and section-land boundaries.
Council discussion centered on transportation and utilities. Council members pressed the applicant about sidewalks, road improvements and traffic studies. Constantakis said right-of-way dedication for Deer Flat Road would be recorded with the final plat and sidewalks would be constructed as new uses come forward: "We anticipate that sidewalks will occur as development comes forward on the site," she said. She also noted that detailed traffic mitigation and sidewalk placement will be refined as specific development proposals are submitted.
Council members and staff noted the relocation of the adjacent canal has been approved by the U.S. Army Corps of Engineers, and that the applicant submitted geotechnical work. The applicant also filed multiple easement-release requests as part of the application; staff said standard public-utility easements required by Kuna code will be implemented on the final plat.
During deliberation councilors emphasized the trade-offs of approving a single commercial parcel. One councilor said a single-lot configuration could permit large-format retail or other commercial uses, while staff and the applicant said any specific projects will return for appropriate permits and likely require traffic impact studies and additional conditions. A council member noted the preliminary traffic information referenced approximately 100 additional vehicle trips on Deer Flat Road tied to future development, but said a formal traffic impact study would be required once there is a defined user.
The council made a motion to approve the combination plat and development agreement modification; the motion passed by voice vote with all members present voting in favor (5-0).
Clarifying details from the meeting: - Parcel area and zoning: council approved consolidation into one C-2 commercial parcel (approximately 34 acres). (source: staff report and applicant presentation) - Easements: applicant submitted about eight easement-release requests as part of the application; new standard public-utility easements will be placed on the final plat. (source: applicant) - Canal relocation: relocation of the Cubic Canal has been fully approved by the U.S. Army Corps of Engineers. (source: applicant) - Sidewalks and right-of-way: right-of-way dedication along Deer Flat Road expected to be recorded with plat; sidewalks anticipated when development occurs and will be required at the time of development. (source: applicant and staff) - Traffic: council referenced a preliminary traffic estimate of roughly 100 additional trips on Deer Flat Road tied to future development; a traffic impact study will be required when trip generation can be estimated by a proposed user. The applicant and the city said they expect the site to return to the city for more detailed review as specific development proposals are filed; councilors asked staff to ensure ACHD and ITD comments on road improvements are addressed as those proposals move forward.
Speakers quoted or summarized in this article include Doug Hansen, Kuna Planning and Zoning Director; Penelope Constantakis, project representative with Riley Planning Services; Mayor Steer; and multiple council members. No formal fiscal or permit approvals for specific buildings were made tonight — the council’s action establishes the lot configuration and removes the existing development agreement so future proposals may proceed under C-2 zoning.
Ending: Councilors approved the plat modification and termination of the prior development agreement 5-0. The council and applicant said they expect additional, project-specific applications and permit reviews to return to the city for design review, traffic analysis and final plat recording.
