The Moffat County Board of County Commissioners on Aug. 12 approved a replat application (S-25-05) submitted by Elwood Martin to divide two parcels in the Sand Springs area so that a residence and a shop would sit on separate five-acre parcels.
Candace Miller, planning and zoning coordinator, told commissioners the parcels meet the county’s five-acre minimum for agricultural zoning and that the planning commission recommended approval. Staff identified a potential issue regarding an existing well location and the status of nearby well permits: one well has an active permit and another existing well does not. Miller said the applicant is creating an easement to allow the lower parcel access to the upper existing well if needed, and was advised to consult the Colorado Division of Water Resources (DWR) about permitting.
Staff also reminded the applicant and prospective buyer that the shop — previously operating under a 2012 conditional-use permit for woodworking — would need a conditional-use amendment if future non-residential uses expand beyond the current permit conditions.
A commissioner moved to approve the Martin replat application; the motion carried on a voice vote with ayes recorded and no roll-call tally documented in the record.
The board and staff did not add conditions beyond the well-permit caution and the reminder about conditional-use requirements for business operations on the newly created parcel.
