The Eastern Summit County Planning Commission approved a conditional use permit and final site plan for an accessory building and accessory dwelling unit in the Foothill Estates subdivision.
Planner Tiffany presented the Stockley application for a parcel in Foothill Estates Phase 1 (Lot 2, 1.94 acres). The accessory building is roughly 3,698 square feet total with an upper-level accessory dwelling unit of about 998 square feet and a 510-square-foot covered deck, Tiffany said. The structure requires a CUP because it exceeds 2,000 square feet; a separate septic system and additional water rights were also required.
Tiffany told commissioners that the owners obtained additional water rights through Weber Basin Water and that the new septic system received approval from the health department. Commissioners asked whether the proposed building would conflict with recorded building envelopes or covenants; Tiffany clarified that county staff enforces the plat as recorded and not private covenants (CC&Rs) unless those limitations are recorded on the plat.
No public comment was received. A commissioner moved to approve the CUP and final site plan per staff findings and conditions; the motion passed unanimously by voice vote. The applicant must record the final site plan and comply with the conditions in the staff report.
