Commission approves garage with accessory dwelling unit at 3920 N. State Road 32 after UDOT access change

The Eastern Summit County Planning Commission approved a conditional use permit and final site plan for an accessory building with an accessory dwelling unit at 3920 North State Road 32 in Oakley.
Planner Tiffany presented the application for a 2,553-square-foot accessory building (about 1,564 square feet footprint) with a 989-square-foot accessory dwelling unit and a 474-square-foot deck on a 3.26-acre parcel in the AG-10 zone. Tiffany said the parcel is a grandfathered conforming lot created before the county’s 1996 zoning changes and remains eligible for development under current rules. The accessory building required a CUP because it exceeds 2,000 square feet and requires a final site plan for recording.
Tiffany told the commission that the applicant originally proposed a separate driveway to State Route 32, but UDOT denied that access. The applicant therefore revised the plan to use the existing driveway through the property and has received approval from the fire district for the driveway location. Tiffany said staff had not received public comments and recommended approval based on findings, conclusions of law and conditions of approval in the staff report.
Commissioners asked about the grandfathered status and the UDOT access denial. Tiffany explained that a parcel that existed in its present configuration prior to May 6, 1996 is considered grandfathered and eligible for development even when it no longer meets today’s minimum-acreage standards. After brief discussion and no public comment, a commissioner moved to approve the CUP and final site plan; the motion carried by voice vote with commissioners recorded as voting aye.
Staff will record the final site plan and the applicant must follow conditions set out in the staff report.
