Bill 250,292 would amend Chapter 9‑600 of the Philadelphia Code to add business hour restrictions for certain late‑night commercial activities across parts of the city, including provisions that would apply in the First, Seventh and Eighth councilmanic districts. The committee approved an amendment to the bill and then moved the amended bill forward after receiving testimony that highlighted enforcement and business‑education concerns.
Karen Fegley, Acting Commerce Director, read testimony on behalf of Deputy Commissioner Francis Healy and Police Commissioner Bethel. The testimony from the Philadelphia Police Department said the department supports addressing quality‑of‑life and public‑safety problems tied to some late‑night businesses but cautioned that expanding curfew enforcement to the entirety of the Seventh and Eighth Police Districts would dramatically increase the number of affected businesses and the geographic area requiring compliance checks. The testimony said the Police Department had previously agreed to enforce more limited curfew zones and had concentrated resources on specific commercial corridors with documented late‑night disorder.
“The proposed expansion would require officers to conduct late‑night compliance checks across a much larger footprint,” the testimony read, and warned that without additional staffing the proposed amendment could lead to inconsistent or uneven enforcement. Fegley added from the Commerce Department that the city’s efforts to educate affected businesses under the original, smaller curfew areas required extensive door‑to‑door outreach and that broadening the law with a short effective timeline would be difficult to implement. She also noted that Philadelphia’s active nighttime economy includes workers who need overnight access to goods and services.
Committee members offered and approved an amendment to bill 250,292; the chair called a voice vote and the ayes carried. The committee then voted to report the amended bill favorably and to suspend the rules to permit first reading at the next council meeting. No members of the public registered for comment on the bill during the hearing.
