Council agrees in principle to easement across Verne Thorpe property to access waterline; owner requests up to 5 acre-feet be attached

Council members discussed a proposed public easement across property owned by Verne (Vern) Thorpe to allow access to a waterline that runs through his property. Greg Evans described the draft easement as granting the city access to maintain or replace the waterline and said Thorpe was not charging for the easement. "This is just to allow us to have access to our waterline that runs through his property," Evans said.
Evans said Thorpe requested additional language permitting up to 5 acre-feet of water to be attached to that well. "The only change that he has requested is if we would add in there that we don't object to having 5 acre feet of water attached to up to 5 acre feet of water attached to that well," Evans said. City staff indicated no immediate objection as long as the request would not interfere with existing infrastructure and recommended legal review of any revised language.
Council members instructed staff to notify Thorpe that the council had no objection to the requested language in principle and asked Todd (staff member) to review the revised easement wording before final action. Mayor Tony Deiber indicated staff would reach out to Thorpe and return the revised draft for one more review by the council.
