LAFCO approves MOU with Mendocino Coast Recreation & Park District to expedite MSR; district to cost‑share study

Mendocino LAFCO voted Feb. 3 to approve a memorandum of understanding (MOU) with the Mendocino Coast Recreation and Park District to expedite an updated municipal service review (MSR) for that district.
Executive Officer E.O. Hinman told commissioners the recreation and park district requested an expedited MSR because its last full review was completed in 2008 and the district has undergone significant operational changes since then. The district board approved the cost‑share arrangement at its Jan. 30 meeting. Under the MOU staff recommended, the recreation district will pay for the MSR professional work while LAFCO will assume the cost of preparing the sphere‑of‑influence (SOI) update—estimated at about $2,500—drawn from the work‑plan contingency. Hinman said staff expects the full MSR to cost between $20,000 and $25,000 depending on analysis scope.
District representatives on Zoom—district administrator Hailey Felicich and board member Dave Schbach—said the district has changed materially since 2008, citing the CV Star facility transition to the City of Fort Bragg, the county’s potential annexation of about 580 acres for surface storage, and Bauer Park maintenance and operations questions on the southern coast. Schbach said the district is current on audits and financial reporting and that recent management work has addressed prior grand‑jury findings; he requested the MSR to provide objective data about finances, service distribution and whether fees should be geographically differentiated across the district’s roughly 77‑mile coastal boundary.
County counsel (Council Bert) advised that an indemnification clause was not required in this cost‑sharing MOU because the MOU covers only who bears preparation costs; indemnification would be addressed during processing of specific project documents as needed.
Commissioner Ward asked whether LAFCO should solicit bids for the MSR since the district will pay for consultant work; staff said LAFCO expects to prepare the MSR in‑house with district support but would consider contracting for water‑study elements. After discussion, a motion to adopt staff’s recommendation carried on a roll‑call vote with all commissioners present voting yes.
The commission directed staff to finalize the MOU and proceed with the expedited MSR and SOI update under the agreed cost‑share arrangement.
