The Zoning Advisory Commission voted unanimously Feb. 5 to recommend approval of a minor subdivision that will convert a single cooperative parcel at Estates of Dubuque into 35 individual residential lots and a separate clubhouse parcel, and to amend the property's planned unit development ordinance to add bulk regulations and a revised conceptual plan.
The change converts a cooperative-style ownership into individual lots so homeowners can hold title to their own parcels while common areas – the clubhouse, detention basin and private streets – remain under a homeowners association, city staff said. Justin Lau of Beeson and Associates, the applicant's surveyor, described the plat as "for 35 lots from 2 lots. Basically it was a communal lot." Mike Dalsing, a homeowner in Vintage Estates, said purchasers formed a board and intend the community to remain a 55-plus development while moving from a co-op to an HOA model.
Why it matters: the requested PUD amendment creates specific bulk regulations (setbacks, frontage, lot area and height allowances) to make the newly platted lots conforming where standard R-1 requirements would otherwise make several units nonconforming. Sheena Moon, associate planner, told the commission the streets, utilities and stormwater controls are already built and the change is primarily a change in the form of ownership and the accompanying development regulations.
Details: the subdivision will produce 35 residential lots plus a separate lot for the clubhouse and a lot for the surface parking area, for an effective total of 36 parcels. Moon noted an earlier platting in 2023 created the existing lot pattern and streets; the current request redraws interior lot lines and adds a conceptual plan and bulk-regulation chart to the PUD to reflect the new lot configuration. Moon said staff discovered and corrected an error in the draft bulk table related to cul-de-sac lot frontage (some cul-de-sac lots will have about 38 feet of frontage rather than 50 feet).
Legal and procedural notes: the commission reviewed a late-submitted letter from an attorney representing Conley Construction that raised timing and signature concerns in the plat-recording process and cited Iowa Code section 354.11 on subdivision plats. City staff and the city attorney advised the commission the letter relates primarily to recording and private legal disputes among parties and does not bar the commission from making a recommendation. Moon said legal counsel Corinna Brumwell "reaffirmed that interpretation." The commission did not table the application based on the letter.
Vote and next steps: a motion to recommend approval of the minor subdivision (Plan A Plat No. 2) carried on a roll-call vote (Zaccaro, Freustad, Lorman, Russell and Mulligan voting aye). A separate motion to approve the PUD amendment passed by the same unanimous vote. Both items will be considered by the Dubuque City Council at its Feb. 17 meeting.
Context and public input: staff reported phone inquiries from neighboring owners and one late letter from counsel; no written opposition was filed in the planning packet. In a brief public comment during the PUD hearing, a neighbor asked whether the homeowners association would be responsible for catch basins and stormwater; the applicant and staff confirmed the HOA would retain those responsibilities under the applicant's plan.
The commission's action is a recommendation to council. Any final recording of the plat must satisfy the recorder's office requirements and signatures noted under Iowa Code § 354.11 before filing.
