Board approves eminent-domain resolutions to advance Southwest 40th / 49th Avenue phase 1 road project

County legal staff explained that Florida and U.S. constitutional requirements limit eminent-domain exercises to acquisitions that are for a public purpose and are necessary to accomplish that public purpose. The resolutions the board approved make the statutory and constitutional findings required to attach the resolutions to petitions in circuit court and permit county attorneys to proceed with filing.
County Attorney staff said the resolutions were narrowed in editing to identify precisely which property interests would be acquired for each parcel (fee simple, drainage easements, temporary construction easements, or partial acquisitions) rather than generically listing fee simple for all parcels. The change reflects the project’s mix of permanent and temporary interests.
Board action: Commissioner Stone moved approval, Commissioner McLean seconded, and the board voted unanimously to approve the resolutions authorizing the eminent‑domain filings for the Phase 1 road project.
Why it matters: The resolutions are a procedural step that authorizes the county to seek court orders to obtain property interests it deems necessary to build a publicly funded road project. County staff said the actions move right-of-way acquisition forward so construction and final design can proceed on schedule.
