TWC tables civilian workforce composition and EEO report; commissioners seek legislative fix for data timing

The Texas Workforce Commission voted on Jan. 9 to defer action on its fiscal‑year civilian workforce composition, hiring practices and equal‑employment‑opportunity (EEO) report after commissioners raised concerns that required data were missing or late.
Kathy (division presenter) told the commission the report consolidates multiple statutory reporting requirements and that much of the supporting data come from outside agencies, including the comptroller and demographic sources. The presenter said the division has been working to secure the data and to improve timeliness but that delivery schedules from other agencies have hampered completion.
Commissioner Esparza pressed staff on the statutory deadlines and on the data years used in the report, noting that section 21.504 of the Texas Labor Code (as cited in the meeting) requires use of data from the preceding state fiscal year and that the report contained data only for 2021–22 rather than for fiscal year 2024 as he expected. Esparza said the commission had two reports already late (two statutory due dates had passed) and urged that the commission put a legislative recommendation in the report to change reporting deadlines if necessary.
Staff recommended delaying action and returning to the commission with a revised report that would include proposed changes to statutory deadlines and an analysis of whether the commission has authority to enforce data submission by other agencies. The commission agreed to table the item and asked staff to return with a revised report and recommended legislative language at the Jan. 21 meeting. No substantive changes to the underlying data were made at the meeting.
