The San Leandro City Council removed from tonight’s agenda an appeal of the Planning Commission’s approval for an 80‑foot wireless telecommunications facility proposed at 440 Peralta Avenue and scheduled the item for a later meeting to allow additional analysis of materials submitted by the appellant.
Mayor Gonzales announced he was "pulling item 8A, the appeal of the Planning Commission's approval for a conditional use permit to build an 80 foot high wireless telecommunication facility at 440 Peralta Avenue ... to be heard on Tuesday, January 21st" to allow staff to review a letter by the appellant’s legal counsel that arrived on Sunday.
The Nut Graf: Appellant counsel Ariel Strauss gave a brief preview during public comment, saying the proposed 80‑foot macro tower is sited on a parcel zoned for transit‑oriented mixed‑use infill close to BART and that AT&T’s projections show nearby buildable parcels could face radio‑frequency exposure levels the Federal Communications Commission treats as unsafe; Strauss urged the council not to approve the permit as drafted and welcomed staff review prior to the rescheduled hearing.
Strauss, who identified herself as "counsel for the appellant for pool agenda item 8a," said the parcel and two neighboring parcels are zoned for dense mixed‑use development near Sempra Verde Park and BART. She argued the tower’s placement next to parcels that could be built up to 65 feet with no setbacks would discourage the infill development encouraged by the general plan and could expose future residents to levels of radio frequency emissions that, in AT&T’s projections, the FCC would consider unsafe.
The council did not take action on the underlying appeal at this meeting. The council’s administrative announcement noted discriminatory or disruptive remarks are not tolerated under federal or state statutes and reminded attendees of meeting decorum and public comment procedures.
