Council approves Area Plan legal-services funding; staff cites SK Hynix case and zoning-enforcement costs

The Tippecanoe County Council on Oct. 14 approved an appropriation to cover legal services for the Area Plan department, citing increased legal expenses tied to zoning enforcement and litigation.
"What's before you today is regarding both zoning enforcement and then some legal work that is connected with some zoning enforcement actions and then some lawsuit related work that is connected with primarily the SK Hynix case," Ryan, an Area Plan staff member, told the council. He said two enforcement cases initiated by his predecessor have progressed to court and have inflated legal bills for the department.
Ryan said the department has shifted enforcement tactics in some cases to rely more on property liens and has seen greater compliance when using multiple liens per infraction. "We've seen greater compliance going down that road, with multiple liens per infraction," he said, and added that the approach should reduce the need for frequent court actions except in the most egregious matters.
Council members asked if the county can recover costs when it prevails. A council member asked, "If we win, do we have chance of recovering some of that?" Ryan replied, "For zoning enforcement? Yeah." He also said that the county has collected some funds from liens to date: "That's my opinion that we have someone that is, you know, taking us all the way to court on zoning enforcement," and he acknowledged earlier collections, saying staff had recovered "10 to 20,000" from liens to this point.
Ryan told the council the appropriation request was intended to carry the department through the end of the year, covering normal monthly legal expenses and finishing work on the two court cases and on work connected to the SK Hynix lawsuit and preparations for the Rainbow Trout Solar matter that led to a Board of Zoning Appeals hearing. He said a subsequent lawsuit had been filed and that he had shared information with county leadership and would return in November to explain the new filing.
The council approved the appropriation by voice vote and asked staff to return with further detail in November on the subsequently filed lawsuit. Ryan indicated lien recoveries could offset some costs if the county prevails in enforcement actions.
The appropriation was discussed during the Area Plan agenda item; no formal rollback or amendment to the appropriation was recorded in the meeting transcript.
