Board approves $552,476 fee-in-lieu for 1201/1255 NC 42 project ahead of DOT realignment

The Fuquay Varina Board of Commissioners on Oct. 21 approved a $552,476.07 fee-in-lieu payment tied to development at 1201 and 1255 NC 42, a decision staff said avoids constructing pavement that NCDOT intends to remove when it realigns NC 42 under project U-5751.
Planning Director Pamela Davidson explained that NCDOT project U-5751 will realign NC 42 away from the development frontage. The requested fee covers the town-required cross section, curb and gutter, storm drainage and additional asphalt that would become redundant after the NCDOT realignment; the developer will still be responsible for turn lanes at driveway entrances.
"The suggested motion tonight is to approve a total of $552,476.07 as a fee in lieu payment for roadway improvements associated with the 1201 And 1255 N C 42 Highway project as presented and recommended," Davidson said.
Council members praised the approach as fiscally prudent because it allows the town to collect funds now instead of having on-site improvements later torn out by a DOT project. "Anytime we can have road improvements that are not sacrificial or a waste of money and be able to use the money for best use. That's what everybody wants to see," one commissioner said during discussion.
The engineering director reviewed the estimate and contingency and confirmed consistency with the identified improvements, Davidson said. The board moved, seconded and the motion carried; no roll-call tally was given in the meeting record.
Staff said the developer remains responsible for driveway turn lanes and that the fee will be used in coordination with DOT's broader project to ensure the town’s transportation improvements are aligned with the realignment work.
