Council gives local consent for off-premise beer license at Lake Smoke and Vape

Pleasant Grove City Council approved local consent for Alamy Tobacco, doing business as The Lake Smoke and Vape, to apply for a state off-premise beer retailer license for its store at 881 West State Street, Suite 160.

City Attorney Peterson explained the business is an existing smoke shop in the Macy—s shopping center and has requested permission from the state Department of Alcohol to sell packaged — "off-premise" — beer. "They are an existing business who have been operating the smoke shop for several years, and they have requested from the Department of Alcohol at the state the permission to sell off premise beer," Peterson said, adding the state requires local consent as part of the application process.

Peterson said staff checked distance requirements and the application meets current city code for separation from community centers; he also said state rules allow sale of beer in the same business that sells smoke shop products. The license would be off-premise only (sealed containers; no on-site consumption) and would require the applicant to comply with state display and advertising rules.

Council member Williams made the motion to approve local consent; council member Lamone seconded. The council voted by voice and the mayor pro tem declared the motion passed.

Peterson noted the applicant has off-premise beer licenses at other Salt Lake County locations but this would be the store—s first license in Utah County. The council did not impose local conditions beyond verification that the application met distance requirements; no members of the public spoke on the item.
