Fees amendment hearing postponed to committee after public-notice shortfall

The Plan Commission moved a proposed amendment to UDO Article 1.29 (filing fees) to the Committee of the Whole for a public hearing Nov. 4 after staff and legal counsel said public-notice procedures were not satisfied for the Oct. 23 meeting.
Sergei Gertrzukin of the Office of Corporation Counsel told the Carmel Plan Commission on Oct. 23 that docket PZ-2025-00205, a proposed amendment to filing fees in UDO Article 1.29, could not be heard at the meeting because the city did not meet its own rules of procedure for public notice even though state requirements had been satisfied.
“Although we did satisfy the state requirements notice, you don't have two thirds of members present to suspend the rules, so you cannot act or receive any information on this today,” Gertrzukin said. He recommended the commission schedule a public hearing at the Committee of the Whole on Nov. 4 if members wanted to expedite consideration.
Mike Hallbaugh, director of Community Services, said the department had missed the newspaper notice deadline, provided updated materials and apologized for the inconvenience. The commission voted to send the docket to the Committee of the Whole and to include the public hearing at the Nov. 4 meeting; the motion carried without a recorded roll-call vote in the minutes.
No changes to fees were adopted on Oct. 23; the commission took only procedural action to move the item to committee where a formal public hearing will be held and any substantive debate and votes can occur.
