Pleasant Grove council amends utility code to let fees be set by resolution

Pleasant Grove City Council on a unanimous vote adopted Ordinance 2025-011, a code text amendment removing a fixed $10 late-fee amount from the utilities sections of the municipal code and making late fees subject to the city—s fee schedule adopted by resolution.

City Attorney Peterson told the council the change is a housekeeping measure: the municipal code currently specifies a $10 late fee for water and sewer accounts, but the city—s fee schedule adopted with the budget now sets different amounts. "I'm proposing that the code be amended to take out the specific reference to the $10 and simply say that it will be set by resolution with the fee schedule," Peterson said during the hearing.

The council opened and closed the required public hearing with no public comment. Council member Williams moved to adopt the ordinance and council member Lamone seconded the motion. The roll call recorded council member Malone yes, council member Williams yes, council member Johnson yes and council member Rogers yes; the mayor pro tem announced the ordinance passed.

The ordinance amends Title 8 (Utilities), chapter 1 (Waterworks System) section 5(e) (Billings, Delinquency) and section 8-4(a)(13) (Sewer System, Annual Statement, Service Charge Penalties) to eliminate the dollar-specific late fee and reference the fee schedule instead. No change to the fee schedule itself was made at the meeting; the council left fee amounts to the budget-adopted resolution.

The council did not receive any public testimony urging a different approach and offered no additional changes during discussion. The ordinance takes effect as provided in the ordinance language.
