Staff noted that Nye County holds approximately 450 acre-feet of water rights in the Gabbs municipal/public-works system, that about 100 acre-feet are currently pumped for municipal use, and that approximately 300 acre-feet remain under County holdings available for sale or lease in certain circumstances. Staff advised that Division of Water Resources reviews were ongoing and that outcomes could take time.
Board members expressed concern that the P2 Gabbs applications seek more water than the basin can sustainably provide and directed the District manager to consult with Public Works (Mr. Tuck was specifically referenced) and to prepare a protest letter if appropriate. The manager agreed to consult public-works staff and to draft a protest for the board’s review and potential filing with the Division of Water Resources.
The board did not vote on a protest motion at the meeting but provided direction to staff to pursue coordination with the public-works utility and, if warranted, to file a protest to protect existing municipal supplies.
