Fremont County sets fees for 10/41 (matters of state interest) applications, starts with $5,000 FONSI and $10,000 permit

The Fremont County Board of County Commissioners approved Resolution No. 44, Series of 2024, establishing fees for submission of applications under the county’s 10/41 guidelines and regulations (matters of state interest). The fee schedule is intended to recover staff and consultant costs associated with review of major projects subject to 10/41 review.
Planning and Zoning Director Dan Victoria explained staff surveyed other counties and found a wide range of approaches. "So on the last slide... for the FONSI, the finding of no significant impact, a starting point of $5,000 and for the 10.41 permit, $10,000," Dan said. He described the model as a baseline fee with additional billing and outside consultants billed at their rates; once initial permit fees are exhausted, county staff time would be billed at $200 per hour.
County Administrator Tony and commissioners emphasized that 10/41 reviews typically address major projects that require consultants and that fees protect taxpayers from shouldering review costs. The board noted the 10/41 regulations were previously adopted to take effect January 1, 2025, and that this fee schedule will also take effect on that date.
The board approved Resolution No. 44 by roll call vote with Commissioners Bell, Grantham and McFall voting aye.
Ending: The county will implement the fee schedule concurrent with the 10/41 regulations and invoice applicants for consultant and staff review costs as projects progress.
