Building and Fire Code Board of Appeals adopts supplemental findings denying three appeals

The Building and Fire Code Board of Appeals voted unanimously on Sept. 4 to adopt supplemental findings of fact that supplement board orders denying three appeals identified in the meeting record as BOAB 20 25000002, 00003 and 0004.

City staff told the board the supplemental findings put the board's rationale in writing and tie the denials to the board's powers and duties under the applicable code. "Staff is requesting and recommending that you adopt the supplemental findings as presented," a city staff member said during the meeting.

A board member moved to adopt the supplemental findings (items 1 through 5 in the document presented to the board); Tommy Willis seconded the motion. The board asked each member to state their vote; members recorded as voting yes were Kyle Lombardo, Tommy Willis, Patrice Monroe, Jim McWhorter, Austin Burton and Anne Weber. The chair stated the motion passed unanimously and the supplemental findings were adopted.

The supplemental findings were described by staff as written justification that supplements the board's orders from the Aug. 13 hearing, setting out the grounds for denial based on the board's discussion and the code. The meeting record indicates no additional debate on the content of the findings during the Sept. 4 session.

The board approved the minutes from its Aug. 13 meeting earlier in the session and then moved to adopt the supplemental findings before adjourning. No amendments to the findings were recorded in the Sept. 4 meeting minutes and no next steps or appeals filed after the Sept. 4 vote were discussed on the record at that session.

The board adjourned after adopting the supplemental findings.
