Henderson County Commissioners Court approved a contract to purchase a 3.94‑acre property that includes the former Prosperity Bank building in the 7 Points area for $775,000, the court said during its meeting.
County Attorney staff told the court the parties negotiated revisions to the seller’s original contract and removed most deed restrictions. The county will post $25,000 in earnest money with the title company if the court approved the purchase; closing is scheduled on or before March 1, 2026, the attorney’s office said. The seller agreed to remove three pages of proposed deed restrictions but retained one restriction that the property not be used as a future financial‑institution branch; an ATM on site is allowed.
The county attorney described the site as a comparatively good value and said county staff toured multiple properties before recommending this purchase. Commissioners said the building — roughly 6,000 square feet as discussed in the meeting — could accommodate the tax office and the justice of the peace (JP) for Precinct 2, and would leave room on the parcel for a future vote/ election center. The attorney also noted much of the existing office furniture (desks and chairs) will remain in the building, which reduces furnishing costs for the county.
Commissioner Spivey moved to approve the contract; Commissioner McCam seconded. The motion passed unanimously by those present. The court authorized the county judge to sign the contract and directed staff to place the earnest money with the title company. County staff reported they plan to include the final purchase payment in the 2026 budget.
The purchase agreement, as approved, requires no additional deed restrictions beyond the seller’s retained prohibition on future use as a bank; the county may place an ATM at the site. Closing is contingent on the seller vacating and completing remodeling of a separate facility, which Prosperity Bank is handling, and the county will take possession after closing.
