Sponsor Senator Wyler described the substitute as a consensus change allowing the Water Quality Board to engage in settlement negotiations and mediation and to recommend reasonable penalty amounts to the director for users such as sewer districts. "It makes some modifications to the water quality board so that they can engage in some settlement negotiations and mediation," Wyler said on the floor.
Senators temporarily circled the bill after a question about a fiscal note on the substitute. After confirming the fiscal note concern had been resolved, the Senate un‑circled the bill and moved to final passage. The clerk recorded a unanimous vote of 29–0 for first substitute Senate Bill 36; the measure will be returned to the House.
The floor discussion included clarifying that the changes were intended for enforcement processes and that the substitute addressed technical and procedural authority rather than creating a new penalty schedule on the floor.
