The James City County Chesapeake Bay Preservation Board on Oct. 8 approved a series of Resource Protection Area (RPA) exception requests for residential projects and recorded one extension request; it also deferred a major new‑home proposal at 121 Mahogany Run after neighbors raised concerns about drainage and tree loss.
Staff recommended approval for most applications, describing impacts and mitigation plans in detail. "Staff has reviewed the application and exception request and has determined the impacts associated with the proposal to be moderate/major for the proposed development," watershed planners told the board on multiple cases; the board then acted, typically by unanimous 5–0 votes.
Key approvals and conditions: - CBPA25‑0110, 130 Cooley Road: Exception to replace a driveway and construct a patio and gazebo. The lot is 0.77 acres with 69% in the RPA; impacts total 686 sq ft in the landward 50‑ft RPA. Required mitigation of 1.5 planting units was exceeded by the applicant’s plan (3 canopy trees, 3 understory trees, 50 shrubs). Staff recommended approval; motion passed 5–0. Conditions include a $1,500 surety and a one‑year start window (construction must begin by Oct. 8, 2026) and standard permit requirements. - CBPA25‑0079, 104 Doral (Ford’s Colony): Addition of a retaining wall, deck and patio with 163 sq ft net increase to the RPA. Staff characterized impacts as moderate but recommended approval with a $500 surety for the additional mitigation (half planting unit/6 shrubs). Applicant Chase Grogg said the wall would be under 3 feet tall, be segmental and include an underdrain; the board approved 5–0. - CBPA25‑0090, 117 Pleasant Point: Siting of a 10-by-12 shed with 120 sq ft of landward RPA impact. The applicant proposed mitigation equal to 6 shrubs; staff recommended approval with a $500 surety. The property owner (Artem Portka) confirmed the nearby septic tank constrained siting. Board approved 5–0. - CBPA25‑0107, 105 Ambrose Hill: Replacement of a failing retaining wall with 157 sq ft of new impervious in the landward 50‑ft RPA; staff recommended approval with mitigation of six shrubs (half unit) and a $500 surety. Board approved 5–0. - CBPA25‑0091, 4428 Landfall Drive: Small addition that required relocating and replanting a conservation easement on site. Staff described it as a low‑impact RPA encroachment; the applicant proposed nine shrubs, exceeding the half‑unit requirement. Conditions include a deed of exchange for natural open space and a $500 surety. Board approved 5–0.
Contested and deferred items: - CBPA25‑0072, 121 Mahogany Run (Ford’s Colony): Proposal for a new single‑family dwelling and attached deck on a 0.514‑acre lot where 100% of the parcel lies within the RPA. The application proposed 1,400 sq ft of landward impacts and 2,544 sq ft seaward impacts, with mitigation consisting of one canopy tree, eight understory trees and 90 shrubs plus three micro‑bioretention BMPs. Neighbors raised concerns about tree loss, root damage and cross‑lot drainage; neighbor Jane Banfield asked for an additional 10‑foot setback to protect trees and requested the final mitigation planting be coordinated after construction. Applicant representative Chase Grogg said he was willing to add a berm and coordinate landscaping with staff and Ford’s Colony controls, but the applicant requested more time for neighbor coordination. The board accepted the request to defer the case to the Nov. 13 meeting; motion passed 5–0.
Other business: The board accepted a staff request to extend CBPA24‑0116 (a prior approval) for one year with reauthorization of existing permit conditions and a new expiration of Nov. 14, 2026. Board elections were announced for the November meeting; the board noted the November meeting date differs from the usual second‑Wednesday schedule.
Next steps: Approved applicants must submit the listed sureties, obtain required federal/state/local permits and record affidavits or deeds where required. The deferred Mahogany Run application will return to the Nov. 13 docket for further neighbor and applicant coordination.
